    When you contact us to make an enquiry, we will use your name and contact information to respond. We will then use this information to communicate with you during the provision of our services to you. We collect and update information about users of our services. We may obtain this information via direct contact with you, from third parties such as other users who refer you to us or automatically via your use of our services.

    To better serve site visitors, ExpatlandTM collects two basic types of information:

    Personally identifiable information: This is information that personally identifies one individual from another (for example, names, e-mail addresses and other contact information). This information is voluntarily provided to us by our site visitors and is used by us for the purpose of fulfilling requests or inquiries or processing event registrations.

    Aggregate user and tracking information: This information gives us insights on how our site visitors use our site. This data is anonymous and does not contain any personally identifiable information. We use this information to ensure that our website, e-mails and marketing efforts continue to appeal to our site visitors.

    ExpatlandTM only collects personally identifiable information that you voluntarily provide, when you sign up to attend a seminar or receive communications from us, or send us an e-mail. Examples of such personally identifiable information that you provide to us may include, among other information, your name, physical address, email address, phone number and, website user name.

    ExpatlandTM only requires personally identifiable information from you when it is needed to complete your request for information, complete an online transaction (e.g., online registration for an event), or when you voluntarily decide to register to receive communications from us.

    When you visit the ExpatlandTM website, we may automatically collect some information about your visit using cookies, log analysis software and other aggregate tracking technologies.

Some ExpatlandTM cookie files remain on your computer’s hard drive unless and until you manually delete the file. ExpatlandTM cookie files do not contain personally identifiable information or track an individual users’ movement through our site

    (c.) To send surveys to you.

    We sometimes contract with other companies and individuals to perform functions or services on our behalf, such as hosting the ExpatlandTM site, sending email messages and informational newsletters and administering surveys. They may have access to personal information, such as email addresses, needed to perform their functions, but are restricted from using it for purposes other than providing services for ExpatlandTM.

    In the event ExpatlandTM, or substantially all of its assets were acquired, or in the unlikely event that ExpatlandTM goes out of business or enters bankruptcy, website user information, including personally identifiable information, would be one of the assets that is transferred or acquired by a third party.     Registration confirmation e-mail messages

    When you register for an event via the ExpatlandTM site, you will receive an e-mail confirming your registration.

    Marketing or promotional e-mails

    If you sign up for one of our marketing or newsletter e-mails, we will send you the marketing e-mail and/or newsletters that you have requested.

    We only send these e-mails to site visitors who sign up for one of our mailing lists or who agree to future contact regarding communications from ExpatlandTM. These mailings contain clear information on how to unsubscribe.

    If you are receiving communications from us and wish to unsubscribe, either follow the unsubscribe instructions in the communication or follow the opt-out instructions below to inform us that you do not want to receive e-mail from ExpatlandTM.

    Whether you are a consumer or a business user:

    • ExpatlandTM does not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
    • Subject to the following paragraph, ExpatlandTM‘s aggregate liability for any claims arising in any calendar year shall be limited to the fees paid (if any) to ExpatlandTM by you during that calendar year.
    • ExpatlandTM will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    • use of, or inability to use our site; or
    • use of or reliance on any content displayed on our site.

    In particular, ExpatlandTM will not be liable for:

    • loss of profits, sales, business, or revenue;
    • business interruption;
    • loss of anticipated savings;
    • loss of business opportunity, goodwill or reputation; or

    ExpatlandTM will only use your personal information as set out in our Privacy Policy.

    Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy set out in section 19 below.

    ExpatlandTM has the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy set out in section 19 below.

    • waive any moral rights in the Works to which you are or may at any future time be entitled, including (but without limitation) the right to be identified, the right of integrity and the right against false attribution, and agrees not to institute, support, maintain or permit any action or claim to the effect that any treatment, exploitation or use of such Works or other materials that infringe your moral rights;
    • undertake not to register nor attempt to register any intellectual property rights in the Works, unless requested to do so by ExpatlandTM, and to do all acts necessary to confirm that the absolute title in all intellectual property rights in the Works has passed, or will pass, to ExpatlandTM; and
    • agree to indemnify ExpatlandTM and keep indemnified at all times against all or any costs, claims, damages or expenses incurred by ExpatlandTM, or for which ExpatlandTM may become liable, with respect to any intellectual property infringement claim or other claim relating to the Works supplied by you to ExpatlandTM.
  • 16. We are not responsible for viruses and you must not introduce them

    We do not guarantee that our site will be secure or free from bugs or viruses.

    You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

    You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. You will report any such breach to the relevant law enforcement authorities and ExpatlandTM will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

    You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

    If you become an E-Team member of ExpatlandTM, you shall promote our site by displaying the “proud member of the Expatland E-Team” logo. The logo shall be in the form provided by ExpatlandTM to you from time to time, be displayed in an appropriate and reasonably prominent location on your website and be of the size that ExpatlandTM may require from time to time.

    You must not establish a link to our site in any website that is not owned by you.

    Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

    ExpatlandTM reserves the right to withdraw linking permission without notice.

    The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy set out in section 19 below.

  • 19. Acceptable Use Policy

    ExpatlandTM requires you to comply with its Acceptable Use Policy, which are its content standards that apply when you upload content to our site, make contact with other users on our site, link to our site, or interact with our site in any other way.

    Our Acceptable Use Policy is set out in paragraphs a – d below.

    a. Prohibited uses

    You may use our site only for lawful purposes. You may not use our site:

    • In any way that breaches any applicable local, national or international law or regulation.
    • In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
    • For the purpose of harming or attempting to harm minors in any way.
    • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
    • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
    • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

    You also agree:

    • Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our Terms.
    • Not to access without authority, interfere with, damage or disrupt any part of our site, any equipment or network on which our site is stored, any software used in the provision of our site or any equipment or network or software owned or used by any third party.

    b. Interactive services

    ExpatlandTM may from time to time provide interactive services on our site, including, without limitation:

    • Member forums;
    • Chat rooms;
    • Bulletin boards; and
    • Networking services,

    (“interactive services“).

    Where ExpatlandTM provides any interactive services, ExpatlandTM will provide clear information to you about the kind of services offered, if they moderated and what form of moderation is used (including whether it is human or technical).

    ExpatlandTM will do its best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and ExpatlandTM will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, ExpatlandTM is under no obligation to oversee, monitor or moderate any interactive service ExpatlandTM provides on its site, and ExpatlandTM expressly excludes its liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

    The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. ExpatlandTM advises parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive service should be made aware of the potential risks to them.

    Where ExpatlandTM does moderate an interactive service, ExpatlandTM will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

    c. Content standards

    These content standards apply to any and all material which you contribute to our site (“Contribution“), and to any interactive services associated with it.

    The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.

    ExpatlandTM will determine, in its discretion, whether a Contribution breaches the Content Standards.

    A Contribution must:

    • Be accurate (where it states facts).
    • Be genuinely held (where it states opinions).
    • Comply with the law applicable in England and Wales and in any country from which it is posted.

    A Contribution must not:

    • Be defamatory of any person.
    • Be obscene, offensive, hateful or inflammatory.
    • Promote sexually explicit material.
    • Promote violence.
    • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
    • Infringe any copyright, database right or trademark of any other person.
    • Be likely to deceive any person.
    • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
    • Promote any illegal activity.
    • Be in contempt of court.
    • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
    • Be likely to harass, upset, embarrass, alarm or annoy any other person.
    • Impersonate any person or misrepresent your identity or affiliation with any person.
    • Give the impression that the Contribution emanates from ExpatlandTM, if this is not the case.
    • Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
    • Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
    • Contain any advertising or promote any services or web links to other sites.

    d. Breach of our Acceptable Use Policy

    When ExpatlandTM considers that a breach of this Acceptable Use Policy has occurred, ExpatlandTM may take such action as ExpatlandTM deems appropriate.

    Failure to comply with this Acceptable Use Policy constitutes a material breach of these Terms upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

    • Immediate, temporary or permanent withdrawal of your right to use our site.
    • Immediate, temporary or permanent removal of any Contribution uploaded by you to our site.
    • Issue of a warning to you.
    • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
    • Further legal action against you.
    • Disclosure of such information to law enforcement authorities as ExpatlandTM reasonably feels is necessary or as required by law.

    ExpatlandTM excludes its liability for all actions ExpatlandTM may take in response to breaches of this Acceptable Use Policy. The actions ExpatlandTM may take are not limited to those described above, and ExpatlandTM may take any other action ExpatlandTM reasonably deems appropriate.

  • 20. Which country’s laws apply to any disputes?

    These Terms of use, their subject matter and their formation, are governed by English law and the courts of England and Wales will have exclusive jurisdiction.

    Expatland Global Network Pte Limited (Expatland) is a limited company organized under the laws of Singapore (Company No. 201731172E) which facilitates connections throughout the world between expats and legal and other client related professional service providers (individually, a “Service Provider”) who can provide the assistance needed for an individual to transfer from one country to another. Each Service Provider is constituted and regulated in accordance with relevant local regulatory and legal requirements. The use of the name Expatland Global Network Pte Limited is for description purposes only and does not imply that Service Providers are in a partnership with each other or with Expatland Global Network Pte Limited. The responsibility for the provision of services to the client is defined in the terms of engagement between the Service Provider and the client and Expatland Global Network Pte Limited disclaims any responsibility for any services provided to a client by a Service Provider. Expatland Global Network Pte Limited itself does not practice law nor offer legal, tax, accounting or other advice. Expatland Global Network Pte Limited disclaims any responsibility or liability for acts or omissions of any of its Service Providers.
